2. For what purposes does the BACH patent law firm process your data and on what legal basis (Article 13(1)(c) GDPR, Article 14(1)(c) GDPR)?
Your personal data will only be processed for the main purpose insofar as this is necessary for the BACH patent law firm to perform its tasks or you have expressly consented to this.
The legal basis for data processing operations related to the performance of the tasks and powers of the judicial authorities is Article 6(1)(b) GDPR and the relevant provisions of the respective procedural or professional regulations. If special categories of personal data (such as health data) are processed at all, this is done exclusively on the basis of Article 6(1)(a) and Article 9(2)(a), (b), (e), (f), and (j) GDPR and the respective legal bases, but only to the extent necessary in the context of activities as a judicial authority or patent attorney. In all other respects, the Federal Data Protection Act, as amended, applies to the BACH patent law firm.
Even after the conclusion of proceedings, the data may be processed to fulfill other legal obligations, such as to comply with statutory retention requirements. In this case, the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG) apply.
Your personal data will only be processed for purposes other than those mentioned if there is a legal basis for the respective data processing, for example to perform the task of a public authority, or if you have expressly consented to such further processing in advance.
Other purposes include accompanying or supporting functions, such as personnel administration, prospect management, applicant data management, supplier and service provider data management, and other activities necessary for the administration of a patent law firm.
3. What categories of personal data are processed by the BACH patent law firm?
In proceedings before the authorities and courts, only personal data that is listed and required in the context of the respective proceedings is processed (e.g., addresses, bank account details, and, if applicable, financial data in the context of legal aid).
In principle, however, special categories of personal data (e.g., health data) rarely play a role in proceedings before the authorities and courts and are therefore not processed. If at all, such special categories of personal data are only processed to the extent necessary for representation in the context of patent attorney activities. The legal basis for this is provided by Article 9(2)(a), (b), (e), (f), and (j) of the GDPR.
4. Where does your personal data come from?
Patentanwaltskanzlei BACH may collect your personal data not only directly from you as the data subject. Other sources may also be used, such as parties to proceedings or witnesses, experts, or requests for information or files from authorities and courts. The legal basis for this is provided in particular by the relevant rules of procedure.
5. To whom will your personal data be disclosed (Article 13(1)(e) GDPR; Article 14(1)(e) GDPR)?
The BACH patent law firm will only disclose your personal data to its employees and third parties on the basis of legal provisions or if you have given your express consent.
a) Recipients
Within the BACH patent law firm, only those persons who are entrusted with the execution of the proceedings in which your data is relevant to the proceedings have access to your personal data. These are the patent attorneys and lawyers responsible for the respective proceedings, as well as their assistants, typists, and support staff.
To perform its tasks, the BACH patent law firm uses IT-supported specialist procedures (software) into which your data is entered.
In proceedings where costs are incurred, we may transfer your name and address to collection agencies so that they can perform their tasks of recovering costs.
b) Categories of recipients
The BACH patent law firm transfers personal data in individual cases to
Parties involved in the proceedings in which your personal data has been collected, insofar as this is necessary for the conduct of the proceedings;
Persons to be involved in proceedings in accordance with the respective rules of procedure, for example experts or interpreters; Witnesses will have your personal data disclosed to them insofar as this is necessary for the conduct of the proceedings;
Courts, insofar as this is necessary for the performance of their duties;

Other persons, authorities, and courts in proceedings concerning registers, such as the patent register, utility model register, trademark register, design or registered design register, plant variety register in accordance with the applicable regulations, or other persons who are entitled to inspect files in accordance with the respective rules of procedure.
Regarding Article 13(2) GDPR and Article 14(2) GDPR:
6. How long do we store your personal data? (Article 13(2)(a) GDPR; Article 14(2)(a) GDPR)
Personal data collected in the course of proceedings is included in the case files. The storage periods for the case files are determined by the professional regulations governing the retention periods for files of patent attorneys and lawyers (BoP, BRBo).
Personal data received by the BACH patent law firm in connection with submissions and inquiries, in particular from third parties, is stored in accordance with the periods specified for the storage of procedural files.
Data not affected by this is deleted when the purposes mentioned under 2. no longer apply or after the task has been completed.
